Terms of use

Last updated: 17 September 2026

These terms of use (the "Terms") govern access to and use of the fundraising platform of Kapka Zhivot Foundation (the "Foundation", "we") at kapkajivot.bg and related services (the "Platform").

By creating an account, starting a campaign or making a donation, you enter into a contract with the Foundation on these Terms. Merely browsing public content does not constitute acceptance. If you do not accept the Terms, do not create an account, start a campaign or donate.

For users in Bulgaria, the Bulgarian text prevails. Translations are provided for convenience.

1. The Foundation and the Platform

Kapka Zhivot Foundation (Фондация „Капка Живот“), UIC/EIK 208627658, registered office: Republic of Bulgaria, Haskovo 6300, 16 Osmi Mart Street, represented by Kristina Ivanova Kancheva, Chair of the Management Board, is a non-profit legal entity. The Foundation is entered in the Central Register of non-profit legal entities carrying out activities in the public interest.

The Foundation operates the Platform to raise funds for medical treatment, social causes and other legitimate needs. Campaigns are reviewed before publication.

Every donation made through the Platform is a donation to the Foundation. A donation to a specific campaign is a donation to the Foundation with a stated purpose in favour of that cause. A donation to the Foundation Fund is a donation to the Foundation for its public-benefit activity, which the Foundation allocates under these Terms.

The Platform is not a bank, payment institution or investment service. A payout to an organiser, beneficiary, medical institution or supplier is aid under the Foundation's internal rules, not a payment service on behalf of the organiser.

2. Definitions

"User" — a person with a registered Platform account. "Organiser" — a User who creates and manages a campaign. "Donor" — a person who makes a donation, with or without an account. "Beneficiary" — the person or group the campaign is for. The beneficiary is not a separate account. "Campaign" — a fundraising page, including the story, goal, updates and related content. "Donation" — a voluntary cash gift to the Foundation made through the Platform, including to a campaign or to the Fund. "Fund" — the Foundation's general fund, which may receive donations without a specific campaign and from which the Foundation may allocate amounts to approved campaigns. "Payout" — a bank transfer by the Foundation in connection with a campaign, after review and approval.

3. Eligibility and accounts

You must be 18 or over to register an account or act as an Organiser. A donor under 18 may donate only with the consent and involvement of a parent or guardian. By donating you confirm that you meet this requirement. The Foundation does not verify age on every guest donation.

You are responsible for your login details and for all activity under your account. Registration information must be accurate and kept up to date.

We may suspend or terminate an account that breaches these Terms, provides false information, or is used for fraud or abuse.

4. Campaigns

4.1. Creating a campaign

Only registered Users may create campaigns. By submitting a campaign you confirm that:

  • the information is true, complete and not misleading;
  • you have the right and, where applicable, consent to raise funds for the named beneficiary, including consent to publish their personal data and, for medical causes, health data; for children, the consent of a parent or guardian;
  • the funds will be used for the purpose described in the campaign;
  • you will comply with applicable law, including tax and reporting duties.

4.2. Review and approval All campaigns are reviewed by our team before publication. We may request supporting documents (medical records, invoices, identity documents and others) and may refuse, pause or remove a campaign that does not meet our standards, is unlawful, misleading or appears fraudulent.

4.3. Campaign content You must not publish content that is unlawful, defamatory, hateful, discriminatory, sexually explicit, that infringes third-party rights, or that contains unnecessary sensitive data (for example a personal identification number or a full medical file). We may edit, hide or remove content that breaches these rules or the law.

4.4. Updates Organisers should post regular, honest updates on the use of funds and progress of the cause. Failure to provide updates or requested evidence may delay or block a payout.

5. Donations

5.1. Legal nature A donation is a voluntary gift to the Foundation. It is not a purchase of goods or services and is not subject to withdrawal under distance-selling rules for goods, except as set out in section 5.5.

5.2. Purpose When you donate to a campaign, you state a purpose in favour of that cause. The Foundation takes due care to apply the proceeds in line with that purpose, subject to section 9.

5.3. Payment methods We accept bank transfer to the Foundation's account. When enabled on the Platform, we also accept card payments via Stripe, including Apple Pay and Google Pay if Stripe offers them for your device. Donations are processed in euro (EUR) unless otherwise stated.

5.4. Donations without an account A guest donor provides a name and email address. If you choose anonymous or partial display, that applies only to the public campaign or Fund page. The Foundation and the payment processor receive the data needed to complete the donation and for accounting.

5.5. Refunds

Once successfully received, a donation is not refundable as a rule. A refund is made where:

  • there is a technical error or a duplicate payment;
  • the payment never arrived (failed card transaction or a bank transfer that was not received);
  • fraud or another material breach is established and the funds have not yet been paid out — in that case the Foundation may refund the donor or direct the amount to the Fund, depending on the circumstances and applicable law.

When a refund is made, the donor receives the Charged Amount — the Donation Amount plus any processing-fee coverage they paid. The payment processor may retain its fee; the Foundation absorbs that cost.

Card disputes (chargebacks) are handled under Stripe's and the card issuer's rules.

5.6. No guarantee of outcome We do not guarantee that a campaign will reach its goal or that treatment, aid or the cause will achieve the expected result. The Foundation does not make medical decisions and does not determine the type or place of treatment.

5.7. Donation certificate The Foundation issues a donation certificate. It may be used for tax purposes to the extent the law allows relief for donations to a public-benefit non-profit legal entity. Requests are sent to info@kapkajivot.bg, with the donor's and the donation's details. Issuance through the Platform may be added later.

6. Fees

Creating and running a campaign on the Platform is free for organisers. The Foundation does not charge a platform fee.

Card and digital-wallet donations incur a processing fee charged by the payment processor, shown at a published rate before you pay. Bank transfers carry no processing fee.

Unless you choose to cover the processing fee, it is deducted from what the campaign or the Fund can pay out. The amount you chose still counts in full towards the publicly shown raised total. If you cover the fee, you are charged a little more so that amount reaches the cause in full.

Covering the fee is optional. It is not a donation to the Foundation's own operations. The current rate and a calculator are on the Fees page.

7. Payouts

7.1. Available balance A campaign's available balance comprises successful donation amounts to it and allocations from the Fund, minus refunds, processing fees that the donor did not cover, and payouts already made. Only successful donation amounts and active Fund allocations count towards the public raised amount. A refunded donation (and its uncovered processing fee) drops out of that balance.

7.2. Payout request Organisers may request a payout when there is an available balance. Each request is reviewed. We may ask for further documents before releasing funds.

7.3. Method and recipient

Payouts are made by bank transfer only. Cash is not paid out. The Foundation may transfer to:

  • the organiser's or the beneficiary's account;
  • a medical institution or supplier in connection with the campaign purpose;
  • the organiser as reimbursement of proven campaign-related expenses.

7.4. Use of funds Paid-out funds must be used for the purpose stated in the campaign. Misuse may result in refusal of payout, account termination and legal action.

7.5. Timing We aim to process approved payouts promptly. Timing depends on verification, bank schedules and applicable law. We are not liable for delays caused by banks or payment providers, except in cases of intent or gross negligence on our part.

8. Foundation Fund

Donors may give to the Fund. Those donations support the Foundation's public-benefit activity. An organiser of an active campaign that is still below its goal may apply for an allocation from the Fund. Approval is at the Foundation's discretion, within the available balance and the Platform rules. An approved allocation increases the campaign's raised amount. Aggregated figures for amounts collected and allocated, and Fund donations according to the donor's chosen visibility, are shown publicly.

9. Unused funds, suspension and death of the beneficiary

If a campaign is suspended as fraudulent or unlawful before payout, section 5.5 applies.

If the beneficiary dies, related and proven costs of the cause are covered first. The Foundation may direct any remainder to the Fund or to other campaigns with a similar purpose.

If unused funds remain after the goal is reached or the campaign is closed, the Foundation may, after attempting to contact the organiser, direct them to the Fund or to a similar cause.

A paused campaign does not accept new donations. In that case you may support the Fund.

10. Prohibited conduct

You must not:

  • create fake campaigns or misrepresent the beneficiary, the need or the use of funds;
  • use the Platform for money laundering, terrorist financing or other unlawful activity;
  • impersonate another person or organisation;
  • circumvent review, payout or security processes;
  • disrupt the Platform;
  • use donated funds for purposes other than those described in the campaign.

11. Intellectual property

Campaign content you submit remains yours. You grant the Foundation a non-exclusive, royalty-free licence to display, reproduce and promote it in connection with the Platform and the cause, for as long as the content is public or needed for accountability and lawful retention. For photos and data of beneficiaries, including children, this licence rests on the consent the organiser must obtain.

The Platform's name, logo, design and software belong to the Foundation or its licensors. You may not use our brand without prior written consent.

12. Privacy

How we process personal data is set out in the Privacy Policy. Cookies and similar technologies are set out in the Cookie Policy. Those documents are informational. They are not accepted automatically merely because you browse the site.

13. Disclaimers and limitation of liability

The Platform is provided as available. The Foundation is not a party to a dispute between organiser and donor about the use of funds already paid out. We do not guarantee the accuracy of campaign content, for which the organiser is responsible.

Liability for intent, gross negligence, or in cases where the law does not allow exclusion — including mandatory consumer protection — is not excluded.

Apart from those cases, the Foundation is liable only for direct damage caused by a breach of its duties under these Terms.

14. Indemnity

The organiser agrees to indemnify the Foundation against claims, damage and reasonable costs (including reasonable legal fees) arising from untrue or unlawful campaign content, lack of required beneficiary consent, or another breach of these Terms caused by the organiser.

15. Changes to the Terms

We may update these Terms. The revised version is published on the Platform with an updated "Last updated" date. Material changes will be notified by email or by a notice on the Platform when we have your email address. Continuing to use services that require acceptance — an account, a new campaign or a new donation — after changes take effect means you accept the updated Terms. For a donation already made, the version in force at the time of the donation applies, unless the law requires otherwise.

16. Termination

We may suspend or terminate your access if you breach these Terms or if the law requires it. You may close your account in settings or by writing to info@kapkajivot.bg. Closure does not affect donations already made, reporting duties or lawful retention of accounting data.

Provisions that by their nature should survive termination, including limitation of liability, indemnity, governing law and rules on data already collected, remain in force.

17. Governing law and disputes

These Terms are governed by the law of the Republic of Bulgaria. If you are a consumer, you also have the mandatory protection of the law of your country of habitual residence where that law applies.

Disputes not resolved voluntarily are brought before the competent court in the Republic of Bulgaria, unless mandatory rules confer another jurisdiction.
